Please read these Terms and Conditions carefully before using BuddyFood-AI. By accessing or purchasing through the Service, you agree to these Terms, our Privacy Policy, Refund Policy, and any plan-specific checkout terms shown before payment.
1Agreement, Scope and Operator
These Terms govern access to and use of BuddyFood-AI, including the website, quiz, calculators, AI-generated nutrition plans, PDF files, account features, subscriptions, support, and related digital services. BuddyFood-AI is operated by the legal person, sole trader, or business entity identified in the checkout, invoice, website footer, or legal/contact details. Those operator details must be kept accurate and available to users where required by law.
2Consumer Rights and Mandatory Law
Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable consumer protection law. If you are a consumer in the European Union or European Economic Area, you may have mandatory rights under consumer, digital content, data protection, and unfair contract terms rules. If any clause conflicts with mandatory law, the mandatory law prevails and the rest of these Terms remain in effect.
3Eligibility and Excluded Use Cases
You must be at least 18 years old and have legal capacity to use the Service or purchase a plan. The Service is not intended for minors, pregnant or breastfeeding individuals, people with eating disorders, people with serious medical conditions, or anyone who has been advised by a healthcare professional to follow a specific diet unless they first obtain approval from a licensed healthcare professional.
4Digital Wellness Tool, Not Medical Care
BuddyFood-AI is a digital wellness and nutrition-planning tool. It is not a medical device, clinic, healthcare provider, registered dietitian service, diagnosis tool, or emergency service. The Service does not provide medical advice, diagnosis, treatment, or professional nutritional counselling. Always consult a physician, registered dietitian, or other qualified professional before starting a diet, weight-loss, muscle-gain, exercise, or nutrition program, especially if you have allergies, medical conditions, take medication, or experience symptoms.
5Medical Emergencies and Safety
Do not use the Service for medical emergencies or urgent health decisions. If you believe you may have a medical emergency, contact local emergency services immediately. Stop following any plan and seek professional advice if you experience concerning symptoms, significant fatigue, dizziness, pain, digestive issues, allergic reactions, disordered eating patterns, or any other adverse reaction.
6AI-Generated Content and Human Review
The Service may use automated algorithms and artificial intelligence to generate or assist with meal plans, calculations, insights, recipes, shopping lists, and other recommendations. AI-generated output can contain mistakes, omissions, unsuitable suggestions, or outdated information. You are responsible for reviewing the plan before using it. BuddyFood-AI does not guarantee that AI output is complete, error-free, medically appropriate, or suitable for your individual circumstances.
7Calculations, Estimates and Results
Calorie targets, BMR, TDEE, BMI, macros, body composition, and progress estimates are planning references only. The calculators in Tools use classic standard formulas for quick reference. The quiz may apply additional layers of formulas, safety checks, goal logic, and practical adjustments, but all results remain estimates. BuddyFood-AI does not guarantee weight loss, muscle gain, health improvement, performance improvement, maintenance, or any specific outcome. Real results depend on adherence, health status, genetics, sleep, stress, activity, tracking accuracy, medication, and many other factors.
8Allergies, Ingredients and Food Safety
You must accurately disclose allergies, intolerances, restrictions, avoided foods, medical conditions, and dietary needs. You are responsible for checking every ingredient, label, allergen warning, substitution, restaurant item, and food preparation method before eating. BuddyFood-AI cannot guarantee that all allergen risks, cross-contamination risks, product changes, substitutions, or local ingredient variations will be detected. Do not follow a plan or recipe if it appears unsafe for you.
9User Responsibilities
You agree to provide accurate, complete, current, and truthful information. You are responsible for deciding whether to use any plan, recipe, calorie target, or recommendation, for monitoring your own response, and for seeking professional advice where appropriate. BuddyFood-AI is not responsible for consequences caused by inaccurate data, incomplete answers, ignored warnings, misuse, or use contrary to professional medical advice.
10Accounts and Security
You are responsible for keeping your login credentials secure and for all activity under your account. You must notify us promptly if you suspect unauthorized access. We may suspend or restrict access where we reasonably believe there is fraud, abuse, security risk, payment risk, or a violation of these Terms.
11Orders, Contract Formation and Electronic Contracting
Before placing an order, you should review the selected plan, price, currency, billing interval, email address, and any checkout notices. A contract is formed when payment is successfully authorized or when the checkout flow otherwise confirms your order. We may send confirmation by email and may store plan/order information in your account. The contract may be concluded in the languages made available in the Service, currently English and Romanian where supported.
12Payments, Prices and Taxes
Paid features may include one-time digital plans, Smart packages, Premium subscriptions, upgrades, or other products shown at checkout. Prices, currencies, taxes, discounts, and billing terms are displayed before payment and may vary by location, currency, promotion, plan type, and payment provider. Payments are processed by third-party payment processors such as Stripe; we do not control your bank or card issuer fees.
13Digital Content Delivery and Right of Withdrawal
The Service supplies digital content and/or digital services, including personalized plans that may be generated and delivered shortly after payment. Where required by law, you may be asked to expressly request immediate delivery and acknowledge that you may lose the statutory right of withdrawal once digital performance begins or the personalized digital content is made available. If mandatory law gives you a withdrawal, refund, conformity, or remedy right that cannot be waived, that mandatory right remains unaffected.
14Subscriptions, Credits and Upgrades
Premium subscriptions renew automatically until cancelled. Cancellation prevents future billing but does not automatically refund past billing periods unless required by law or by an applicable refund policy. Smart packages may provide scheduled plan credits over a defined period. Premium may grant one credit per billing cycle. Credits are intended for plan updates and may be subject to availability, account status, abuse prevention, and plan-specific rules shown in the product or checkout flow. Unused plan credits granted during a paid period may remain available after cancellation or expiration, but no new credits are granted and Premium-only features end when the paid subscription period ends. Smart-to-Premium upgrades may be scheduled to start after the Smart period ends, with Premium billing and Premium-only features starting at that time.
15Refunds and Chargebacks
Refund eligibility is governed by the separate Refund Policy and by mandatory consumer law. Please contact support first if something goes wrong so we can investigate and resolve the issue. This does not limit any mandatory rights you may have. Fraudulent, abusive, or bad-faith chargebacks may result in account suspension, loss of access to disputed digital content, and the submission of order, account, delivery, and usage evidence to payment processors.
16Acceptable Use and Prohibited Conduct
You may not misuse the Service, attack or test system security without authorization, scrape or mass extract data, reverse engineer protected parts of the Service, attempt to bypass payment or access controls, resell generated plans, use the Service to build competing products, upload malicious code, abuse support, impersonate others, or use the Service unlawfully. You may not prompt, manipulate, or use the Service in a way intended to produce unsafe, illegal, infringing, or medically inappropriate output.
17Intellectual Property and Personal License
BuddyFood-AI, its software, branding, interface, algorithms, prompts, workflows, templates, generated layouts, recipes, text, graphics, and other content are protected by intellectual property and unfair competition laws. Subject to your compliance with these Terms, you receive a limited, personal, revocable, non-exclusive, non-transferable license to use the purchased plan for your own private, non-commercial purposes. You may not resell, publish, license, redistribute, or commercially exploit the Service output without written permission.
18Feedback and User Submissions
If you send feedback, support messages, ratings, progress notes, or improvement suggestions, you grant us the right to use them to operate, secure, support, and improve the Service, subject to our Privacy Policy and applicable data protection law. You must not submit content that is unlawful, infringing, abusive, or misleading.
19Third-Party Services
The Service may rely on or link to third-party services such as payment processors, hosting providers, email providers, analytics tools, authentication providers, AI providers, or external resources. We are not responsible for third-party websites, banking systems, card issuer decisions, internet outages, or third-party terms and policies, except where mandatory law provides otherwise.
20Availability, Maintenance and Changes
We aim to keep the Service available and useful, but we do not guarantee uninterrupted, error-free, or permanent availability. We may update, modify, suspend, or discontinue parts of the Service for maintenance, security, legal compliance, abuse prevention, provider changes, or product improvement. Where a change materially affects a paid subscription or mandatory consumer rights apply, we will handle it according to applicable law.
21Conformity of Digital Services
Where mandatory digital content or digital services law applies, you may have rights if paid digital content or a paid digital service is not supplied or is not in conformity with the contract. Nothing in these Terms removes those mandatory remedies. Outside mandatory rights, the Service is provided on an “as is” and “as available” basis, and we disclaim warranties to the maximum extent permitted by law.
22Limitation of Liability
To the maximum extent permitted by applicable law, BuddyFood-AI and its owners, contractors, affiliates, suppliers, and service providers are not liable for indirect, incidental, special, consequential, punitive, or economic losses, loss of data, loss of profits, failed outcomes, or losses arising from misuse, inaccurate user input, reliance on AI output, ignored warnings, third-party services, or events outside our reasonable control. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, intentional misconduct, or liability that mandatory law says cannot be excluded.
23Liability Cap
To the maximum extent permitted by law, our aggregate liability for claims relating to the Service is limited to the amount you paid to BuddyFood-AI for the product or subscription giving rise to the claim during the twelve months before the event. This cap does not apply where mandatory law prohibits such limitation.
24Indemnity for Misuse
To the maximum extent permitted by law, you agree to compensate and hold BuddyFood-AI harmless from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use, commercial misuse, infringement of third-party rights, security abuse, fraud, chargeback abuse, or breach of these Terms. This clause does not reduce mandatory consumer rights.
25Termination and Suspension
We may suspend, restrict, or terminate access if you breach these Terms, create security or payment risk, abuse the Service, misuse generated content, or if continued access would expose us, other users, or the Service to legal or operational risk. Where feasible and appropriate, we may provide notice or an opportunity to resolve the issue.
26Governing Law and Disputes
These Terms are governed by Romanian law, without prejudice to mandatory consumer protection rules that may apply in your country of residence. Disputes should first be raised with our support team so we can try to resolve them amicably. If no resolution is reached, disputes will be handled by the competent courts under applicable law. For consumers, this does not remove any mandatory right to bring claims in the courts or before authorities available under consumer protection law.
27Consumer Redress and ADR
If you are a consumer in the EU, you may have access to alternative dispute resolution or consumer redress bodies in your country. The European Commission’s former Online Dispute Resolution platform was discontinued on 20 July 2025; use the current national or EU consumer redress resources available at the time of your complaint.
28AI Transparency and System Protection
Where the Service uses AI-generated or AI-assisted content, you acknowledge that outputs are generated or assembled by automated systems. You may not attempt to extract, benchmark, copy, reverse engineer, or circumvent proprietary prompts, model workflows, algorithms, safety layers, ranking systems, or meal-generation logic except where such restriction is prohibited by mandatory law.
29Miscellaneous
If any part of these Terms is invalid or unenforceable, the remaining parts remain in effect. Our failure to enforce a clause is not a waiver. We may assign or transfer our rights and obligations as part of a merger, sale, reorganization, or business transfer, subject to applicable law. These Terms, together with referenced policies and checkout terms, form the agreement between you and BuddyFood-AI for the Service.
